Under Italian law, Moggi could have renounced to prescription should he really have wanted to clear his name. He would have ended up serving a 2 year four month prison sentence.

The Court of Cassation confirmed the judgment of the Court of Appeal that had sent Moggi to prison and he only avoided jail as the charges were time-barred.

So, it is not correct to say that the judgment of second instance was overturned last March : it was in actual fact confirmed.

The Italian concept of prescription is ludicrous and allows rich people like Moggi to retain powerful lawyers who can adopt dilatory tactics which will give rise to prescription.

“Preskritt” at the request of those persecuting him, not his own lawyers. He was always wanted to clear his name. By no means was he an angel, far from it, but this case is far too complicated for anyone to even bother looking into unless they have personal interest

The report is about the Calciopoli judgement of the Court of Cassation of March 23, 2015 which found that many of the charges against Moggi had fallen through the passage of time – the statute of limitations.

The Court observed that there was no doubt that Moggi had committed the crimes of criminal association (associazione a delinquere) and fraud (frode sportiva) and had acquired personal advantages.

Moggi’s crime of criminal association was “widely structured and diffused in a capillary manner throughout the whole territory, with the full cognizance of all who participated in it”.

Moggi’s acquittal was only due to ‘prescription’ – the passage of time which in Italy also runs during the criminal trial and appeals.
