I think it is safe to state that, in his MEPA application, Dr Borg used “devious methods”. This transpires not only from the fact, noted previously, that the two dwellings that are supposed to be distinct (and therefore unconnected) are actually connected (and therefore indistinct), but also from another fact that transpires from a careful analysis of the drawings submitted by Dr Borg’s architect.

As stated previously, the application in question (PA 02708/14) proposes the construction of two residences. Also, one applicable planning policy requires residences to not exceed 200 square metres in floor area (measured externally).

Now, a conservative measurement of the floor area of each floor in the proposed development, gives a total of 437 square metres — i.e. about 9% more than permitted by the applicable policy. This excludes all terraces and service shafts, as well as the lift shaft (there is a lift in the proposed development) — attached table illustrates.

Significantly, while in all upper floors the application gives the floor area of each dwelling, when it comes to the basement it simply gives one floor area (120 square metres) without distinguishing between the two tenements. (All rooms in the basement are shown as “domestic store” or “utility” and, considering that this ‘basement’ is at the same level of the pool deck and landscaped garden, these designations seem pretty suspect, to say the least.)

Once the floor area at basement level is taken into consideration in the entire floor space of the proposed two-dwelling development, the total floor area of the two residences exceeds the permitted maximum (see table). Moreover, the floor area of EACH ONE OF THE TWO PROPOSED DWELLINGS EXCEEDS THE PERMITTED MAXIMUM OF 200 SQUARE METRES FOR EACH TENEMENT. They are BOTH in breach of the applicable planning policy.

IF the applicable planning policies had to be applied, this planning application Would have been refused for the same reasons given in the previous (refused) application (PA 01637/12), namely, “the proposed… building exceeds the maximum permitted floorspace of 200m²”.

It’s approval is in blatant breach of the applicable planning policies.

“Devious methods” are every day fare at a MEPA whose decisions are placed conveniently outside the competence of the law courts and therefore would be nigh impossible to prove that they are illegal.

It does not take too much imagination to realise that Robert Musumeci is a front for others. What he is doing is not “inappropriate”, but exactly what is expected of him as a person of trust under this administration.

He’s just the fixer architect people engage when they want to get things pushed through the Planning Authority. And the only reason he’s in with the Labour Party is because he lives with Jose Herrera’s sister.

When he began seeing her, he was a candidate for the Nationalist Party.
