No. If I, or any one of us, hold a company in Panama, the reason would most probably be to stash illegal funds. There are a lot more jurisdictions where you can just park your money just to avoid taxes. The big multinationals do it all the time.

I don’t agree with prosecuting people for defamation. I agree with civil damages.

The threat of prosecution is not a deterrent. You have ample proof of that in Malta.

And I say this as somebody who is one of the most defamed people in Maltese history.

Why would prosecution be more interesting to a victim than a civil suit? In a civil suit, you get damages. In a prosecution, the state gets the money (a fine).

That’s not how it works. Judgements in libel proceedings are for damages. They don’t require you to destroy the offending item – not even at judgement stage, let alone before.

The Labour Party wants Simon Busuttil and Ann Fenech to break the law. It is insisting that the UBO should be revealed, against all applicable fiduciary rules and in violation of the Maltese Criminal Code.

Article 257 of the Criminal Code provides that “If any person, who by reason of his calling, profession or office, becomes the depositary of any secret confided in him, shall, except when compelled by law to give information to a public authority, disclose such secret, he shall on conviction be liable to a fine (multa) not exceeding 46,587 Euros or to imprisonment for a term not exceeding two years or to both such fine and imprisonment”

Surely, a request by the PL (through their stupid press releases) does not equate to a being “compelled by law”!!!

Ah! ok. I go it now. This is a question of pseudo-entrapment.

Keith Schembri is a millionaire despite his company losing hundreds of thousands every year for the last few years. All this with a turnover of millions. I bet that his company receives invoices for a few millions every year from companies based in Panama or BVI, for “consultancies”. Probably he would not pass an audit by a big 4 firm, that’s why he is refusing.
