The very purpose of the trust as a concept is to alienate that property from the settlor in favour of the trustees who hold the same (the property and hence title thereof) for the benefit of the beneficiaries upon the happening of an event (say the death of the settlor).

As such the property does not belong to him and therefore it is not his asset and therefore he can not declare it. In the same way as you can not insure something which does not belong to you.
