No, it really is because people don’t want to get involved. A financial reward is not sufficient incentive, because it carries the inherent risk that their name will go on the record as the person who took the reward (it would have to).

Another factor is that people in Malta don’t like to be the cause of things or the trigger of consequences for others unless they specifically have it in for those others. I’ve noticed it bothers them. They don’t even want to trigger consequences for criminals. And they won’t report suspected child abuse “because then who knows what will happen to the child who will be taken into care and it might be worse”.

It’s not fear for what will happen to the child in care. It’s not wanting to be the cause of that themselves – for fear of some divine retribution or karma?

People don’t report because they don’t want to get involved. It’s as simple as that. It’s completely in line with the thinking “if there’s nothing in it for me, then why bother”.

They will report with alacrity if they think there’s something in it for them, even if it’s merely the satisfaction of getting their back on a neighbour they don’t like.

The right of a defendant to a lawyer of his or her choice is predicated on 1. whether the lawyer accepts the brief, and 2. whether the defendant is able or willing to pay the lawyer’s fees.

There is a lot of confusion surrounding this business about the right to a lawyer of one’s choice. You have every right to a diamond bracelet, but that right ends where your ability to pay for it, and the owner’s willingness to sell it to you, begins.

You’re confusing issues. Nobody can force anybody, warranted professional or otherwise, to take on a client.

Lawyers are completely free to accept or decline a brief. It’s nobody’s business but theirs.
