The two New Zealand trusts are SEPARATE. They are holding instruments for SEPARATE companies incorporated in Panama. The money and assets are owned not by the trust but by the company. The trust ‘holds’ the company.

Mrs Mizzi is a beneficiary of her husband’s trust. Mrs Schembri is not a beneficiary of her husband’s trust. I suspect that she may not even have known about it, and that Schembri set it up to defraud her, just as Brian Tonna, the corrupt accountant who advised him, set up a similar structure and funnelled money and assets into it so as to defraud his wife before he left her for another woman.

Under Maltese law, spouses can lay claim, should the marriage break up, to half of whatever was earned in marriage. But here’s the thing: they have to know about it and they have to know where it is and prove its existence.

Schembri wasn’t planning on dying any time soon when he set up that New Zealand/Panama thing. He was in his late 30s.

So when Keith Schembri dies, the money will go to Konrad Mizzi’s wife? Why doesn’t Keith Schembri’s wife raise hell?
