Article 77 (5) (c) of the Constitution states: if the Prime Minister recommends a dissolution (of Parliament) and the President considers that the Government of Malta can be carried on without a dissolution and that a dissolution would not be in the interests of Malta, the President may refuse to dissolve Parliament.

In my opinion, this should be what the President should do. Labour have enough majority to move on without Joseph Muscat and Konrad Mizzi, and it is in the interest of Malta to see through the arrest of JM/KM/KS before elections.
