Even if late, these are encouraging developments. The snowball has started gathering mass and those institutions that should have acted long ago are realising it cannot be stopped and now want to catch up before it swallows them whole.

This is good news for the profession. But the public should know that the Malta Institute of Accountants is just a professional body with no real enforcement capabilities.

The real regulator over such matters is the Accountancy Board under the Ministry of Finance which responds to the Minister of Finance – Scicluna.

One of the conditions for holding an accountancy warrant (which is issued and controlled by the Accountancy Board) is that the accountant should always act with the due diligence and integrity and not be involved in anything that can even cast a shadow over the profession.

Another condition is that an accountant is obliged to report to the authorities any suspicion of illegality especially with regard to the Prevention of Money Laundering Act.

It’s about one year and two months too late. Action is only being taken now following Kommerzbank decision. The Malta Institute of Accountants must have had its arm twisted by the Castile gang not to rock their boat, but there’s a limit.
