The less said, the better
I have been informed that Consuelo’s defamation case – the police vs Daphne Caruana Galizia – has been assigned to Magistrate Antonio Micallef Trigona.
I’m afraid I’m going to have to petition the Chief Justice to have the case reassigned.
I will give my reasons to him privately.
Magistrate Micallef Trigona is not in a position to sit in judgement over me for a defamation case in which one of the statements made was that Magistrate Herrera is not fit for office because she cheated regularly on her husband.
It’s not so much about the cheating and lying (though that, too).
It’s about the exposure to blackmail, and the slippery path into tahwid which led to, among other things, this magistrate presiding over the prosecution of her secret lover’s brother.
Magistrate Micallef Trigona cannot give me a fair hearing in this one.
Not only was he in the same position as Magistrate Herrera at one time (though he didn’t preside over the prosecution of his secret lover’s brother), but when he went briefly off the rails, he was also part of her social group.
And the woman with whom he went off those rails is still one of Magistrate Herrera’s closest friends.
Magistrate Micallef Trigona would be nuts to accept this case, and I would be nuts to accept having my case decided by somebody who is compromised.
There is another reason why a question mark hangs over whether justice will be seen to be served if Magistrate Micallef Trigona is the one who gets to decide whether I have defamed his colleague or not.

The case is on-going and the next hearing is in a couple of weeks. So while Magistrate Micallef Trigona is hearing Magistrate Herrera’s case against me, Magistrate Herrera is going to be hearing Magistrate Micallef Trigona’s case against another man – and Magistrate Micallef Trigona’s lawyer is a former Super One/KullHadd journalist and current Labour Party insider, to boot.

I appreciate that judges and magistrates need to have some protection from politicians (not that it did them much good during the Mintoff years) but they should not be such a privileged class, practically immune from any form of discipline.

[Daphne – No, Joe, things do get missed when the headlines leave the front page because of the number of posts, and then ‘disappear’ from immediate vision when you load the home page, especially when this happens over the course of 24 hours. I can tell what’s being missed and what’s being seen through the administration side, which logs the number of views each post receives.]
Just a thought, Daphne, maybe you are doing too many short posts too often. Could be better off with one daily post covering a number of different matters.

How can anyone have faith in the justice system, when there is all this tahwid going on between the magistrates? AGAIN a case of friends of friends.

Malta Today’s Saviour (excuse the pun, but that’s his name) thanked you Daphne for increasing interest in and sales of Malta Today.
I must admit I was one who helped the sales margin go up today. Though he should know that I only did so to see Malta Today’s take on what was recently brought to the public’s attention as to those who sit in judgement over others.
Saviour Balzan said he doesn’t exchange many words with Magistrate Scerri Herrera herself, but does he speak regularly to her partner? He must do – after all, Musumeci writes a weekly column for him.
Was it a mere coincidence that Malta Today and Illum did not make it in time for the TVM newspaper review on Sunday, 31 January – possibly because the ‘hot story’ that turned out to be a damp squib was pulled at the 11th hour?
My €1 loss today was Saviour’s gain, but his loss today was so much greater.

Fr. Borg`s article is excellent through and through. It has to be a priest – and Daphne – to sum up the essential points at stake in this whole sorry episode. As an aside, may I add on the following: would’t it be marvellous if the Saul in Daphne turned out to be a Paul in the making in this Pauline year?

If there is tahwid going on between the magistrates as CFB puts it I would imagine it goes on at a higher level with judges protecting their own?

In a separate case, former Police Commissioner George Grech was cleared of criminal guilt. Nonetheless, he had to resign because what was said in open court brought his office in disrepute if not ridicule. (…) If the organs responsible to put citizens minds at rest about the conduct of the judiciary are ineffective, the media have a most onerous and important role to perform. Silence is definitely not always golden.”
