Magistrate Herrera in new request for protection order
Magistrate Consuelo Scerri Herrera has submitted a new request to the Magistrates’ Court to issue a protection order to stop Daphne Caruana Galizia from writing new posts about her in her blog.
The new application was filed by the magistrate’s legal counsel, Stephen Tonna Lowell.
The original request was made at the opening of defamation proceedings against Ms Caruana Galizia.
Police Inspector Sandro Camilleri has asked the Magistrate Tonio Micallef Trigona to issue the protection order to bar Ms Caruana Galizia from writing anything further about the subject.
The officer pointed out that the “crimes” had continued but the argument was shot down by defence counsel Roberto Montalto, who argued that the prosecuting officer was throwing the principle of presumption of innocence out of the window.
He added there was nothing that the magistrate needed to be protected from.
The court had down the original request. A second, verbal request was also rejected.

Ommi ma, Daphne. A LOT of people just turned purple.
“He added there was nothing that the magistrate needed to be protected from.”
Other than herself. She is her own worst enemy.
Miskina.
Was Jason Micallef, the head of Super One, at the party too? He’s certainly a party in this one.

So that means Magistrate Herrera is hearing at least seven cases that involve her friends.
They won’t be so friendly after she steps down.
Who said she’s stepping down?
I hope this was not a scene from the enactment of Snowhite and her Seven Elves?
About time the Commission for the Administration of Justice makes a move.
“Backstage shenanigans, Consuelo’s Birthday”…indeed
Moira Delia?
Is this the case of who let the dogs out?
Et tu Ira?
Hold your horses, what wrongdoing did Moira and Ira commit?
Ok today is the Ides of March!
Only that they should be dancing away at MY party, not Consuelo’s.
Dirty old man!
I’m Losco’s age. That’s why she should be at MY party. But Hugh Hefner I am not. And neither am I Scerri Herrera.
And you ain’t yet seen this entry from Ira on her own FB wall:
“If I sit on a cushion and fart how long do you think it will take for the fumes to disperse and start to produce a somewhat ‘unfriendly’ odour? …….JUST WONDERING! lol Physics question di!March 4 at 8:33am ·” http://www.facebook.com/#!/ira.losco?v=wall&ref=search
And another piece of Facebook philosophy by Ira: “Ira Losco is bored, picking her nose and making origami out of it”.
Nice friends for a magistrate.
I think that there’s something wrong with you, Gina. You’re not thinking clearly. Who doesn’t want Ira for a friend? She was invited to a party and she accepted the invitation.
Are we saying here that all those invited to Consuelo’s parties are corrupt, or shouldn’t have accepted the invitation on ethical grounds?
Eh? She did nothing wrong?! Mela ha nghidlek jien what she did wrong. She’s a celebrity showgirl, now aspiring to do a nude photoshoot. If she’d been invited by Marc Dorcel, she should have gone. By David LaChapelle, ditto. By the chairman of Virgin Music, ditto with knobs on. But a magistrate’s party? Doesn’t that strike you as odd and totally out of sync with Losco’s media image?
@ H.P Baxxter
Actually, I don’t think Ira Losco did anything wrong, for her age. I am familiair with it, believe me. If it were my son or daughter, they would probably have gone too, “ghall-buzz”.
The magistrate, however, thinks she is a super-star celebrity, and has to be seen with people who can be perceived to be related to that status. She issued the invitation after all.
Once again, it’s back down to Scerri Herrera’s behaviour and ethics.
You’ve got it backwards, John Schembri. No one’s said that all guests are corrupt. What’s been said is that some of the magistrate’s friendships are inappropriate. That does not reflect badly on the person concerned. It just reflects badly on the magistrate herself.
Alan, in my book, “wrong” is not necessarily a moral definition. I’m talking about wrong marketing here. In a nutshell, Scerri Herrera’s do isn’t hip enough for someone who’s just published a coffee-table photo album of “A Day in the Life of”.
Jesus, my comments lose their pizazz when I have to explain them.
Int ukoll, Moira. Shame on you.
Moira Delia – Laburista fahxija, to use the adjective of the moment. Didn’t you know that, Troy?
And no good demi-monde is complete without an ageing showgirl or five.

Moira and Teletubi in S&M session.
Toni Abela must be wild with jealousy. He’s fancied that rubber puppet for yonks.
If he were at one particular party, there’d have been more rubber/ silicone on which to feast his eyes, only it would have been under the flesh, not on a puppet.
What I find amusing is the fact that the magistrate tries to gag an opinion-writer through the law courts and loses. But not so amusing is the fact that if this magistrate felt that she stood a chance in obtaining this ban, then one could conclude that had this case been before the good magistrate, this request would have been acceded to.
Surely the judiciary must agree on certain basic elements and principles of law. Are we to be judged on one magistrate’s interpretation and differently on another’s?
@ TROY
Sorry, but why should Moira be ashamed? She did nothing wrong in going to the party. Maybe the magistrate should have thought it through before posting wild party pics on Facebook.
@GINA
Ira did no harm. She’s just messing about.
And yes, they are nice friends but then again I’m not a magistrate.
“And yes, they are nice friends but then again I’m not a magistrate.”
BINGO!
Let Ira act how she wants, say the crudest, most disgusting things she wants to. But don’t associate yourself publicly with her if you are a magistrate.
The photos were taken at a private party. Fine. But then look what happens when you invite somebody who takes a camera along and sticks the results on Facebook with the title ‘Consuelo’s party’ – as though Consuelo is just another showgirl or singer and not a magistrate – along with inane comments.
Right. You’re not a magistrate. So now you know.
Isard du Pont – She may be a Laburista, but she does a hell of a lot for the animals many “nice” people dump onto the streets.
I don’t care what she does for animals. It’s what she does for human beings that counts.
Where does Moira OR Ira fit in the picture? I don’t give a hoot about the creed/colour or name of a person. Adding to that, the afore mentioned persons hold no bearings or ‘high positions’. They are ‘guilty’ of being local celebs. This blog, I believe is going totally ‘out of point’.
They don’t or, rather, they shouldn’t. The point is that this was a party given by a magistrate. It’s the magistrate who’s under scrutiny, not her showbiz guests.
Mela ghal birthday party kellha lil cikku u l-poplu?
Maybe Ira was there to sing.
Maybe she was giving lessons to the fat lady. You know, the one who sings when it’s over.
This is all so ridiculous!!! Are people not entitled to be friends anymore? Just because they belong to different scenes, have different jobs and live different lifestyles, does not mean that they cannot happen to be at the same party!! And please explain to me, what harm is there in the picture you see above?! People write, say and do what they want as long as they are not harming other people! Unlike the author of this absurd blog or so they call it! So maybe we should all mind our own business and get on with our lives!!
[Daphne – Oh look, it’s Bianca Butcher. Shouldn’t you be at a funeral round about now? Bradley’s dead. We ARE minding our business, Patsy. This IS our business. The fine mess with the judiciary is the result of people not minding their business before. If you want to get on with your life, go ahead – please. Nobody’s stopping you.]
I really don’t see how Moira and Ira fit in here, and especially with regard to Consuelo Scerri Herrera … let her live her own life .. these people are known people for what they do and they all do it exceptionally well! It’s sad that some people just can’t accept that! Change blog … we’ve had enough …. thanks!
[Daphne – If you’ve had enough, just go. Visiting this site is not mandatory.]
You don’t see how Moira and Ira fit in here. That’s the point. How does show business fit in with the sobriety of the judiciary?
At least you get my point … show the people that you’re human and not cruel as so many people perceive you to be!! (advice there).
[Daphne – Patsy, do I come across to you as somebody who cares what ‘people’ think? If I cared what ‘people’ – I know which ones you’re referring to, the sort I’ve spent my whole life avoiding – think, I would be with them now at some coffee-shop, whining and wondering where my life has gone, while working out how best to flirt with the tennis coach. You get the picture.]
Explain to me … what’s your point in bombarding into people’s lives like that?? The way you speak makes me understand that you have no idea how these people spend their life … definitely by not b****ing about others!! You’re a lost case my dear!!! Goodluck in life … but you will not go very far if you go like this!! For the rest, Moira and Ira … keep it up … Moira for your tv shows and Ira for all you do in the music scene … looking forward to a concert of yours!!!! You rock!
[Daphne – ‘You will not go very far if you go like this’. Oh boy, you have to laugh.]
i see your english is good !!!
Maybe Patsy is not aware that Facebook is a way to make one’s private life public.
Patsy’s own private troubles, like drugs and alco, are splashed on the internet.
well no one has the right to twist and turn people’s private life just coz they see a photo … yes sign of the times (amazing name!!! NOT) i am a drug addict and love my alcohol … Not (again!) … this blog seems to attract the nasty people who share the same hobby … b**** about people!!! I leave you to it!!! Byaaaaa
Patsy, I was not bitching about you. I was telling you what is on the internet. You may call it quoting public sources on the internet. I know you admitted that you suffered from bullying in your younger days (again from the same public sources), but rest assured I never practised bullying, so mine is a fair comment towards you.
George D – If you don’t care what people do for homeless animals, I and many, many others do. A statement like that shows what an insenstive person you seem to be.
She may be an ‘ageing showgirl’ but as we all age as the days go by the girl in the pic certainly seems to be doing a better job than most of us.
On a more serious note, it is surely more interesting to learn why the court case involving Zammit Anthony Sive Ninu Hon. vs Micallef Jason is now entering its third year, why there have been so many deferrals, and why such cases, which are resolved in a matter of months elsewhere, take so long to conclude, racking up huge costs for both the taxpayer and the parties to the legal proceedings. This is the real scandal that a journalist of your calibre should be investigating …..the closeted world that is the legal profession in Malta needs a spotlight on it.
