Magistrate Herrera in new request for protection order

Magistrate Consuelo Scerri Herrera has submitted a new request to the Magistrates’ Court to issue a protection order to stop Daphne Caruana Galizia from writing new posts about her in her blog.

The new application was filed by the magistrate’s legal counsel, Stephen Tonna Lowell.

The original request was made at the opening of defamation proceedings against Ms Caruana Galizia.

Police Inspector Sandro Camilleri has asked the Magistrate Tonio Micallef Trigona to issue the protection order to bar Ms Caruana Galizia from writing anything further about the subject.

The officer pointed out that the “crimes” had continued but the argument was shot down by defence counsel Roberto Montalto, who argued that the prosecuting officer was throwing the principle of presumption of innocence out of the window.

He added there was nothing that the magistrate needed to be protected from.

The court had down the original request. A second, verbal request was also rejected.

        I think that there’s something wrong with you, Gina.You’re not thinking clearly. Who doesn’t want Ira for a friend? She was invited to a party and she accepted the invitation.

        Are we saying here that all those invited to Consuelo’s parties are corrupt, or shouldn’t have accepted the invitation on ethical grounds?

        Eh? She did nothing wrong?! Mela ha nghidlek jien what she did wrong. She’s a celebrity showgirl, now aspiring to do a nude photoshoot. If she’d been invited by Marc Dorcel, she should have gone. By David LaChapelle, ditto. By the chairman of Virgin Music, ditto with knobs on. But a magistrate’s party? Doesn’t that strike you as odd and totally out of sync with Losco’s media image?

        Actually, I don’t think Ira Losco did anything wrong, for her age. I am familiair with it, believe me. If it were my son or daughter, they would probably have gone too, “ghall-buzz”.

        The magistrate, however, thinks she is a super-star celebrity, and has to be seen with people who can be perceived to be related to that status. She issued the invitation after all.

        Once again, it’s back down to Scerri Herrera’s behaviour and ethics.

        You’ve got it backwards, John Schembri. No one’s said that all guests are corrupt. What’s been said is that some of the magistrate’s friendships are inappropriate. That does not reflect badly on the person concerned. It just reflects badly on the magistrate herself.

        Alan, in my book, “wrong” is not necessarily a moral definition. I’m talking about wrong marketing here. In a nutshell, Scerri Herrera’s do isn’t hip enough for someone who’s just published a coffee-table photo album of “A Day in the Life of”.

    What I find amusing is the fact that the magistrate tries to gag an opinion-writer through the law courts and loses. But not so amusing is the fact that if this magistrate felt that she stood a chance in obtaining this ban, then one could conclude that had this case been before the good magistrate, this request would have been acceded to.

    Surely the judiciary must agree on certain basic elements and principles of law. Are we to be judged on one magistrate’s interpretation and differently on another’s?

      Let Ira act how she wants, say the crudest, most disgusting things she wants to. But don’t associate yourself publicly with her if you are a magistrate.

      The photos were taken at a private party. Fine. But then look what happens when you invite somebody who takes a camera along and sticks the results on Facebook with the title ‘Consuelo’s party’ – as though Consuelo is just another showgirl or singer and not a magistrate – along with inane comments.

    Where does Moira OR Ira fit in the picture? I don’t give a hoot about the creed/colour or name of a person. Adding to that, the afore mentioned persons hold no bearings or ‘high positions’. They are ‘guilty’ of being local celebs. This blog, I believe is going totally ‘out of point’.

      They don’t or, rather, they shouldn’t. The point is that this was a party given by a magistrate. It’s the magistrate who’s under scrutiny, not her showbiz guests.

Just because they belong to different scenes, have different jobs and live different lifestyles, does not mean that they cannot happen to be at the same party!! And please explain to me, what harm is there in the picture you see above?! People write, say and do what they want as long as they are not harming other people!     She may be an ‘ageing showgirl’ but as we all age as the days go by the girl in the pic certainly seems to be doing a better job than most of us.

    On a more serious note, it is surely more interesting to learn why the court case involving Zammit Anthony Sive Ninu Hon. vs Micallef Jason is now entering its third year, why there have been so many deferrals, and why such cases, which are resolved in a matter of months elsewhere, take so long to conclude, racking up huge costs for both the taxpayer and the parties to the legal proceedings. This is the real scandal that a journalist of your calibre should be investigating …..the closeted world that is the legal profession in Malta needs a spotlight on it.
