A consideration should be made by the defendants’ lawyers to the effect of Judge Mintoff not being fit to adjudicate on the case.
The defendants should enter a plea for an objection based on impartiality or conflict of interest.
Problem is: it will be Judge Mintoff who will have to decide if he has a conflict of interest.
The judiciary has been in the doldrums for years now.
If this Mintoff is not challenged every time there is the slightest hint of conflict of interest then we will end up with no judiciary and consequently no democracy.
It is up to the Chief Justice.
It is better if he is given his salary without having any cases assigned to him then opening the door to the possibility of dragging the judiciary even further into disrepute.
It has very little left by the way of repute anyway.
I do not know if Judge Mintoff was ever a member or a lawyer of the GWU. If he had no such connections, there may not be any legal grounds for his abstention.
How can he claim impartiality. Having him made judge was just so wrong, and not only because he didn’t practise as a lawyer.
