Arnold jumps onto Joseph's wagon

I’ve received this email, from the same activist who sends me stuff about Zminijietna – Voice of the Left, AD and FAA. I was under the impression that Joseph Muscat was offering this service already.

Dear Friends,

Are you interested in getting back the VAT paid on your car registration fee after Malta’s entry in the EU? We, at Alternattiva Demokratika are initiating legal procedures in this respect:

The situation is as follows:

1) an official letter must be sent to the government (as in all cases when action against government is going to follow). This puts the government in default (bad faith) and is called a “protest”. It would cost about LM 40 (court and legal fees to file)
2) Court action would follow. The lawsuit and lawyer’s fees would cost LM 506 and would quote EU law and policy and ask for a refund
3) The law (ours) mentions a prescriptive period of 2 years within which such lawsuits must be filed. Although it can be argued that people who bought the cars did not know that the imposition of tax on duty was illegal, this is still shaky ground. Hence, it would be preferable for those who have bought a car within the last two years to be the claimants, therefore preferably from March 2007. But this still leaves it possible for buyers of cars from 1 May 2004 till March 2007 to join the court case, if they so wish.

If you agree to the above, we would ask from you a contribution of 40 euros for the protest and eventual court case. Cheque to be made in name of Alt Services and sent to Alternattiva Demokratika, 10 Triq Manwel Dimech, Sliema.

    With shame and contrition I must admit I voted for the guy at the EP elections, as a protest vote. I swear I had no idea that he’s Italian or half Italian. (JJJAAAAQQQQ)

    AD must have cash to spare if they are saying that the cost of an official letter is Lm40 and yet they are asking for a “contribution” of 40 euros to cover such “protest”.
