Chris Said to sue One News for libel over perjury report in custody case

Parliamentary Secretary Chris Said gave false testimony according to a One TV news report last night. But the office of the PS informed MT that this is completely untrue and will be seeking “immediate legal action” against the PL broadcaster.

Junior minister Chris Said gave false testimony in a case regarding the custody of a child in the Gozo courts according to allegations screened on One TV. This was revealed on Sunday night by One Tv. The report said that Chris Said’s testimony with regards to the custody of a young child was declared to be false by a Magistrate. But the office of PS Said were quick to deny the news saying that they would be taking legal action against the station.

So one month ago, Super One told its audience that Chris Said had perjured himself. On what grounds did it do this, and where did it get the ‘news’?

Chris Said hasn’t even been prosecuted yet, let alone found guilty of perjury. The decision to prosecute – we all know now – was taken yesterday.

And we know already what the majority seem to think about prosecuting somebody for perjury who made a mistake and said that something totally irrelevant to the outcome of the case happened in the evening when it happened in the afternoon.

And yet Super One, as far back as a month ago, lied about this to fight Justyne Caruana’s client’s battle, in the interest – it must have thought – of political gain.

What a stinking heap of dung. And I must say at this point that even the Labour Party’s dirty tricks department appears to be devoid of brains. This tactic was bound to backfire bigtime.

Nobody likes to see a good man brought down by the evil intent of others, no matter where they’re sitting in the political spectrum. This is basic human decency.

    What’s really interesting is that Judge Michael Mallia is known for his PN-leaning background. So one might wonder, might there be something we don’t know.

    Let’s not jump to conclusions, whether for or against the accused.

    [Daphne – What conclusions are there to be jumped at? The law is clear: there is perjury only when there is intent (lying, as opposed to error because of memory playing up) and even that is not enough. It also has to affect the outcome of the case. It is the difference between bearing false witness and making a mistake.]

    What a true gentle man Dr. Said turned out to be.

    [Daphne – Justyne Caruana WAS and might very well still be Anthony Xuereb’s lawyer. This is a fact. And if you have the good sense to read between the lines of her statement, you will see that she is not denying it. She is only denying her involvement in one specific piece of criminal law: what is known as a ‘challenge’. Justyne Caruana acted for Xuereb in his attempt at sequestering a new-born baby from its mother. She acted for a man who kicked his baby’s mother out of the house and into the street when the baby was just THREE WEEKS OLD and she was breast-feeding it. Then he tried to get full custody on the grounds that she was ‘mad’ – where have we had that one before – and never forgave Chris Said (her lawyer) for getting full custody for the mother instead, the magistrate having granted it on the grounds that the father’s behaviour in court was so unpleasant as not to instill confidence.]

      You’ve got to be a real bit of rubbish to do that. How could Justyne Caruana help a man who’s tried to separate a newborn baby from its mother? And this why she’s always going on about family life and family culture and how she is a mother bla bla bla.

      the same way the lawyer who defended Dr. Said’s brothers did his.
