I’ve begun to suspect that all the fuss Dalli made about being forced to resign rather than resigning of his own free will is to do with his salary and pension rights.
It doesn’t make sense, otherwise. You’re offered a way out that allows you to keep a modicum of dignity (“let’s allow you to resign and tell the world that it was your dignified choice”), and you throw it back at them and shriek that you’ve been made to go.
Well, now that it’s been announced that he’s going to get 45% of his salary, until what would have been the natural end of his term, and then a pension, we’ll see whether he pipes down.

If Dalli is proven to have known that Zammit asked for 60 million euros with his knowledge and the AG does NOT find a case for fraud then I am definitely turning to a life of crime.

“During today’s midday briefing, the EC’s spokesperson told the press that the Commission had “no evidence of illegal behaviour” by Dalli, who will now recieve a monthly transitional allowance for the next three years – until he retires, or finds a job. He will also be eligible for a pension from the European Commission. The transitional payment corresponds to 45% of his €240,000 salary, while his pension will be paid at the age of 65.”

I think we are missing an important point here.
John Dalli has claimed that in August he sent a judicial letter to Silvio Zammit warning him that he would keep him accountable for any damage to his reputation – http://www.timesofmalta.com/articles/view/20121022/local/Dalli-warned-against-harm-to-his-reputation-in-August.442081
As John Dalli claimed this himself and in direct context to the snus debacle. Therefore, unless Silvio Zammit was in the habit of dropping Dalli’s name for other alleged misdeeds, it is fair to assume that this letter referred to the tobacco legislation.
1. If it a judicial letter as John Dalli claims, as distinct from a plain old letter signed by a lawyer and sent from that lawyer’s office, it would be possible to trace it in the court registry.
2. If John Dalli was, by his own admission, aware of the ongoing OLAF investigation, the judicial letter may be an attempt to distance himself from Mr. Zammit and argue that before the end of the investigation, he had taken pre-emptive measures to distance himself from him.
However, in so doing, John Dalli is implicitly admitting that he knew about the rot – now, did he inform OLAF of this?
Never mind OLAF, The alleged law breaker (Zammit) by having for sale an unauthorized substance meant to be available only in Sweden, Dalli was duty bound to inform the Malta police.
Sending him a ‘judicial letter’, which apparently does not exist, proves that he knew what was going on and should have been up front both with local as well as EU authorities.
He is simply reaping what he had sown a long time ago. Had Barroso handled the affair better, back and forth correspondence, accusations and clarifications would have been totally unnecessary.
Dalli is not implicated in a fraud case. It’s a trading in influence situation, that is using one’s influence or connections with persons in authority to obtain favours or preferential treatment for another. Dalli is guilty of not acting or flagging this situation to his superiors.
John Dalli’s insistence has nothing to do with his salary/benefits and future pension.
He’s after immunity from prosecution. That is exactly why he’s refusing to resign from EU Commissioner and keeps using his former designation.
